Received in apparent good order and condition except as otherwise noted the total number of Containers or other packages or units enumbered below by the Merchants to comprise
the Goods specified below for transportation from the Place of
Receipt or the Port of Loading, whichever is applicable, to the
Place of Delivery or the Port of Discharge, whichever is
applicable, subjected to the terms hereof, (including the terms
of the reverse hereof and the terms of the Carrier's applicable
tariff). In accepting this bill of lading, the Merchant
expressly accepts and agrees to all its terms, conditions and
exceptions, whether printed, stamped or written or otherwise
incorporated, notwithstanding the non-signing of this bill of
lading by the Merchant. One of the signed Bill of Lading must be
surrendered duly endorsed in exchange for the Goods or delivery
order. On presentation of this document (duly endorsed) to the
Carrier by or on behalf of the Holder, the rights and
liabilities arising in accordance with the terms hereof shall
(without prejudice to any rule or common law or statute
rendering them binding on the Merchant) become in all respects
between the Carrier and the Holder as though the contract
evidenced hereby had been made between them. |
